This blog shows decisions or judgments regarding trademarks in the JPO (Japan Patent Office) or courts. I am called an\u00a0<\/span>otaku<\/a>\u00a0for trademarks by my colleagues, which means a\u00a0<\/span>geek<\/a>\u00a0or an anorak. That\u2019s why the title of this blog is\u00a0<\/span>OTAKU<\/a>\u00ae\ufe0f. I will post summaries and my thoughts thereabout on this blog. The first one is indicated below.<\/span><\/p>\n

1. Summary<\/h3>\n

\u00a0<\/p>\n

The subject mark having strong distinctiveness and weak one was judged to be dissmilar to the prior mark having weak distinctiveness. While the word “\u30d1\u30ef\u30fc” (translietration of “POWER”) can be recognized as \u201chigh ability to kill insects\u201d and thus would not give a strong impression, the design and \u201cKINCHO<\/a>\u201d give a strong impression because of their fame. Therefore, an attention would not be paid to only the part “\u30d1\u30ef\u30fc”.<\/p>\n

2. My comments<\/h3>\n

Under Japanese practice, two marks having the same pronunciation are generally considered similar to each other. It was better for the owner of the prior mark to register the mark “\u30d1\u30ef\u30fc” (translietration of “POWER”) alone in order to prevent the subject mark from being registered. Even if the owner had thought that registering only the part “\u30d1\u30ef\u30fc” was difficult due to lack of distinctiveness, the mark comprising the device and “\u30d1\u30ef\u30fc” would have prevent the subject mark from being registered rather than the prior mark.\u00a0\u00a0<\/p>\n","protected":false},"excerpt":{"rendered":"
