In this suit, Nintendo sues the company, which uses the abbreviations of the Nintendo\u2019s famous mark \u201cMARIO KART\u201d and rents cars and costumes. Nintendo tries to stop the use and rent, asserting that the rent for these cars and costumes which are used by the characters in the video games of \u201cMARIO KART\u201d series and the use of the abbreviations should be famous. Although it seems that the request for injunctions was partially accepted, the decision with its grounds has not been disclosed to public by the court yet. The defendant\u2019s press release says that they appealed to the IP High Court.<\/p>\n<p>&nbsp;<\/p>\n<p>Before this request, on January 26, 2017, the JPO made the decision for the Opposition against the trademark registration for the abbreviation of \u201cMARIO KART\u201d between the same parties as follows.<\/p>\n<p>&nbsp;<\/p>\n<p><h3 class=\"line_ttl_02\">Opposition No. 2016-900309<\/h3>\n<\/p>\n<p><img loading=\"lazy\" src=\"http:\/\/bran-design.jp\/en\/wp-content\/uploads\/2020\/05\/20181004002028.png\" alt=\"\" width=\"593\" height=\"280\" class=\"alignnone size-full wp-image-266\" srcset=\"https:\/\/bran-design.jp\/en\/wp-content\/uploads\/2020\/05\/20181004002028.png 593w, https:\/\/bran-design.jp\/en\/wp-content\/uploads\/2020\/05\/20181004002028-300x142.png 300w\" sizes=\"(max-width: 593px) 100vw, 593px\" \/><\/p>\n<ol>\n<li>\n<h3 class=\"line_ttl_02\">Conclusion<\/h3>\n<\/li>\n<\/ol>\n<p>The registration was not cancelled as there is no likelihood of confusion<\/p>\n<p>&nbsp;<\/p>\n<ol start=\"2\">\n<li>\n<h3 class=\"line_ttl_02\">Summary<\/h3>\n<\/li>\n<\/ol>\n<p>These marks were judged to be clearly dissimilar in terms of pronunciation, appearance and meaning. Although Nintendo asserted that \u201c<a class=\"keyword\" href=\"http:\/\/d.hatena.ne.jp\/keyword\/%A5%DE%A5%EA%A5%AB%A1%BC\">\u30de\u30ea\u30ab\u30fc<\/a><span>\u00a0<\/span>(mari car)\u201d is well known as the indicator of the Nintendo\u2019s goods and the abbreviation of the cited mark, this assertion was not accepted.<\/p>\n<p>&nbsp;<\/p>\n<p>The Opposition Examiners indicated that there is not sufficient proof showing that the abbreviation itself is used and well known as the indicator. The famousness was not accepted based on that the abbreviation is simply indicated with the video game title \u201cMARIO KART\u201d in the explanations of documents such as video game magazines and catalogs, and<span>\u00a0<\/span><a class=\"keyword\" href=\"http:\/\/d.hatena.ne.jp\/keyword\/Wikipedia\">Wikipedia<\/a><span>\u00a0<\/span>or the abbreviation alone is indicated only in individuals\u2019 blogs. \u00a0<\/p>\n<p>&nbsp;<\/p>\n<ol start=\"3\">\n<li>\n<h3 class=\"line_ttl_02\">My comments<\/h3>\n<\/li>\n<\/ol>\n<p>When I was a child, everyone around me had abbreviated the video game \u201cMARIO KART\u201d as \u201c\u30de\u30ea\u30ab\u30fc<span>\u00a0<\/span>(mari car)\u201d.
